Landlord Safety Inspection

A landlord is required by the Residential Tenancies Act to keep the property in a safe condition. A landlord has a duty of care to provide a safe house to a tenant under common law. You will not be covered by your insurance. You are likely to violate your Landlords’ Insurance and/or Building Insurance requirements if your property is not kept in a safe state. The majority of insurers demand that a landlord keeps the property in a safe condition at all times.

Your Property Manager is not in charge of this. A certified and insured specialist with appropriate experience and training should inspect buildings for structural faults and safety issues. Your Property Manager or handyman is not qualified to comprehensively check your rental property following Australian Standards.

Deck, balcony, stair, and floorboard collapses are becoming all too common, resulting in deaths and catastrophic injuries. In the end, you, the landlord, are responsible. You may be held accountable if someone is harmed or dies while visiting your rental property owing to a lack of upkeep.
